Acceptance of terms

By accessing refiready.ai or purchasing or using our services, you agree to be bound by these Terms of Service and our Privacy Policy. If you are using the services on behalf of a company, you represent that you are authorized to bind that company to these terms.

Our services

Refiready.ai is operated by Data Acquisition Partners LLC (“Refiready,” “we,” “us,” or “our”), a Delaware limited liability company that provides predictive mortgage refinance lead data to business clients. The specific scope, volume, pricing, and delivery of any data are governed by a separate order form or agreement; these terms govern your general use of the website and services.

Eligibility and business use

Our services are intended solely for legitimate business use by parties who hold any licenses and registrations required to originate or broker mortgage loans or otherwise conduct their outreach. You are responsible for confirming your own licensing and authority before using any lead data.

Not a consumer reporting agency; no FCRA use

Refiready is not a consumer reporting agency, and the lead data we provide is not a “consumer report” under the Fair Credit Reporting Act (FCRA). You agree that you will not use our data, in whole or in part, as a factor in establishing a consumer’s eligibility for credit, insurance, employment, housing, or for any other purpose governed by the FCRA.

Acceptable use and your compliance responsibilities

You are solely responsible for using our data lawfully. Without limiting that responsibility, you agree to:

• Comply with the Telephone Consumer Protection Act (TCPA), federal and state Do Not Call rules, state telemarketing and licensing laws, and all other applicable regulations.
• Maintain your own internal suppression and Do Not Call lists and honor consumer opt-out and do-not-contact requests.
• Respect permitted calling-time windows and obtain any consent your outreach methods require.
• Not resell, redistribute, or sublicense the data except as expressly permitted in your order form or agreement.
• Not use the data for any unlawful, deceptive, or harassing purpose.

Lead data and no guarantee of results

Lead data is generated through predictive modeling and may include estimated values such as estimated interest rates, balances, and equity, which are model-derived approximations and not verified or quotable terms. We do not guarantee the accuracy, completeness, or contactability of any record, and we do not guarantee any particular contact rate, conversion, funded loan, or business outcome.

Intellectual property

The website, its content, and our data products are owned by Refiready or our licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the data solely as permitted by your agreement with us. All other rights are reserved.

Disclaimers

The website and services are provided “as is” and “as available” without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.

Limitation of liability

To the fullest extent permitted by law, Refiready will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or related to your use of the website or services. Our total liability for any claim relating to the services will not exceed the amounts you paid to us for the services giving rise to the claim in the three months preceding the claim.

Indemnification

You agree to indemnify and hold harmless Refiready and its officers, employees, and agents from any claims, damages, liabilities, and expenses arising out of your use of the data or services, or your violation of these terms or applicable law, including any claim relating to your outreach or marketing practices.

Governing law

These terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws principles, and any dispute will be resolved in the state or federal courts located in Delaware.

Changes to these terms

We may update these terms from time to time. When we do, we will revise the “Last updated” date above. Your continued use of the website or services after a change takes effect constitutes acceptance of the updated terms.
